The ANC has failed to remove the MK party from the ballot. Jacob Zuma has spear-headed his own political party and the ANC made efforts to remove the party from the Ballot. In court the presiding over this case had three points to contest ANC’s application. The first point are 1.whether the ANC delayed in bringing the application should be condoned.
2.Whether the court has jurisdiction over the relief that ANC seeks.
3 Whether they went through the proper application of registration for MK when the decision was made to forward it into the Ballot.
The judge addressed point 1, she mentions that the ANC did acknowledge that the application was brought too late (outside the prescribed three days period), the ANC also put up an application for the delay. Since the ANC failed to bring forward the application in a three day period the ANC application has been barred. The party has to give a full explanation for the delay. The ANC only brought the application on the 9th of January 2024 and the matter was first brought forward on the 7th of September 2023.
The ANC’s letter explaining the delay of the application has been deemed irrational by the court because it doesn't justify the delay of the application.The ANC blamed the delay of the application on the fact that they launched the appeal on 20th September 2023 and the appeal got denied in 24th November 2023, the ANC alleges that it was only able to instruct its attorneys to contest the appeal with its attorneys in December 26 2023 and this was done until the 31st of December 2023 after the internal consultations were held. The ANC blames the delay on the fact that their appeal was denied on the 24th November and that they are attending to this matter would have been inconvenient to the staff members who were closing off for the December Holidays. It Is clear The ANC can only blame its own procrastination.
The public is elated over the irony that it was ANC’s own gross incompetence that led to their Appeals falling short. Some twitter users see this as the failure of Fikhile Mbalula on his part. The ANC is now under more pressure because of all the odds stacking up against them.
